Mary J. Fitzgerald is recognized as one of South Dakota’s most active representatives on public safety and a vocal advocate for crime victims. Here are the key highlights:


Public Safety & Criminal Justice Leadership 
Fitzgerald has built a strong record of advancing public safety and holding offenders accountable.
  • Marijuana Public Safety (HB 1061, 2021): Banned smoking and consuming of marijuana in vehicles to keep roads safe.
  • DUI Reform: Led efforts to eliminate presumptive probation for repeat DUI offenders, ensuring consistent sentencing.
  • Stronger Penalties for Violent Crime (HB 1104): Increased penalties for accomplices to first- and second-degree murder.
  • Closing Sentencing Loopholes: Advanced legislation to prevent serious offenders from qualifying for reduced sentencing.
  • Justice for Victims (2025): Prohibited suspended imposition of sentence for rape convictions.
  • Contractor Fraud Protection (HB 1066, 2026): Strengthened laws against theft by contractors and suppliers.

Standing Up for Victims & Children Fitzgerald has been a consistent advocate for protecting victims and strengthening accountability.

  • HB 1175 (2026): Made coaches mandatory reporters of child abuse and neglect

Supporting Local Communities
  • Mining Revenue Reform (HB 1089, 2026):  Modifies the distribution of revenues collected from severance taxes on new mining permits. It provides that, for severance taxes on certain precious metals, 80% of revenues shall be deposited in the state general fund and 20% shall be remitted to the county in which the minerals are extracted.
Open Government and Transparency
  •  HB 1059, clarified that electronic communications - such as emails or group texts-among a quorum of a public board constitute an offical meeting.  This bill was written to prevent local governing boards from conducting public business in private digital channels.
  • HB 1092, updated provisions pertaining to open records.

Why It Matters
Fitzgerald’s work focuses on safer communities, stronger protections for victims, and responsible, conservative leadership that delivers real results for South Dakota families.


In 2026, Fitzgerald successfully passed HB 1089 into law, modifying how revenues from severance taxes on new permits are distributed. This legislation ensures that mineral tax revenue is directed toward mitigating the impacts of mining in our county and other counties in South Dakota where minerals are extracted.

As a sixth generation South Dakotan and growing up on a farm in South Dakota Mary knows our values and what is important to our state.  Mary pledges to protect our way of life and keep South Dakota great for future generations.
As a first-year legislator Mary was the lone legislator that successfully passed a bill on marijuana.  House Bill 1061 became law in South Dakota on July 1st, 2021.  House Bill 1061 prohibits the smoking and consuming of marijuana and its derivates in a motor vehicle.

​Mary Fitzgerald, a lifelong resident of South Dakota, has been an active and hardworking member for the Republican Party for as long as I can remember. ​She is the current chair of the Lawrence County Republican Party and has done a tremendous amount of work on behalf of the Party and Republican candidates for various elective offices.  ​Mary has an accounting degree and at one time she worked for a corporation that operated thirty stores. That experience has given Mary a wealth of knowledge concerning budgets, payroll, taxes and government regulations. I know that experience will be most helpful when bills are proposed that can have a positive or negative effect on the citizens and businesses of South Dakota. As the current and former chair of the Lawrence County Republican Party Mary Fitzgerald has demonstrated that she is willing to do the work and accept the responsibilities that come with the position. A vote for Mary Fitzgerald for the South Dakota House of Representatives is a vote for a candidate with excellent communication skills, a fantastic work ethic, and the business background for be an excellent advocate for the citizens of Lawrence County and South Dakota.
